1. Who you are buying from

Online orders on this website are sold by Piotr Raczynski, trading as Adam's Kitchen Takeaway, 16 High Street, Hawick TD9 9EH. Phone: 01450 218090. The Adam's Kitchen restaurant at the same address is a separate business; these terms cover takeaway orders placed through this site.

2. Your order

When you place an order you will see an on-screen confirmation with an order reference. Your order is accepted — and the contract between us is made — when the kitchen confirms it (shown as "accepted" on your tracking page). We occasionally have to refuse an order, for example when an item has sold out, the address is outside our delivery area, or we are at capacity; if that happens and you have already paid online, you receive a full refund.

3. Prices and payment

All prices are in pounds sterling. The total shown before you place your order is the full amount payable and includes any delivery fee and the statutory carrier-bag charge. You can pay on collection or delivery (cash or card), or online by card at checkout when card payments are offered — online payments are processed by Stripe and your card details never reach us.

4. Collection and delivery

Preparation and delivery times shown are our best estimates, not guarantees — Friday and Saturday evenings are busy. Delivery is available within the area shown at checkout. Please make sure your address, door number and phone number are correct; if the driver cannot find you or reach you by phone, we will hold the order at the restaurant for collection instead.

5. Cancelling an order

Freshly prepared food is exempt from the usual 14-day cancellation right for online purchases (Consumer Contracts Regulations 2013). You can still cancel free of charge at any point before the kitchen starts preparing your food — call 01450 218090 straight away with your order reference. Once preparation has started we cannot cancel the order.

6. If something is wrong

If your order arrives incomplete, incorrect or not up to standard, call us the same evening with your order reference. Where something is our mistake we will replace the item or refund the appropriate part of your order — whichever you prefer where both are practical. Refunds to a card are returned to the card used and typically appear within 5–10 working days. Nothing in these terms affects your statutory rights.

7. Allergens

For allergen information, please call 01450 218090 before placing your order. All dishes are prepared in a single kitchen that handles all 14 regulated allergens, so we cannot guarantee any dish is completely free of traces. The order-notes box is for the kitchen's awareness and is not a substitute for speaking to us about an allergy.

8. Alcohol

Alcohol is sold only to persons aged 18 or over and only during our licensed hours. We operate a Challenge 25 policy: if you look under 25, staff (or the driver, for deliveries) will ask for photo ID — a passport, photocard driving licence or PASS card. If satisfactory ID cannot be shown, the alcohol will be withheld and refunded; the rest of the order is unaffected.

9. Our responsibility to you

We are responsible for loss caused by our failure to take reasonable care, and nothing in these terms limits any liability that cannot be limited by law. We are not responsible for delays caused by events genuinely outside our control (for example severe weather or road closures), though we will always tell you and refund anything we cannot deliver.

10. These terms

These terms are governed by Scots law and any dispute is subject to the jurisdiction of the Scottish courts. If we update these terms, orders already placed stay on the terms shown when you ordered. See also our Privacy Policy.
